Terms of service

1. Definitions

Office — Pobytw.pl, ul. Lalki 5 lok. 3, 02-495 Warszawa.

Client — a natural person, legal person or organisational unit placing an Order.

Service — a translation service or another service indicated in these Terms.

Order — the scope of the Service, deadline, price and method of collection agreed between the Office and the Client.

Sworn translation — a certified translation performed by an authorised sworn translator in accordance with the applicable regulations.

Standard translation — a translation that is not a certified translation.

2. Subject and scope of services

The Office provides sworn, standard and interpreting services, as well as support in matters related to obtaining citizenship. The core offer covers translations from Ukrainian into Polish. By individual arrangement, the Office also provides translations from and into German, English, Belarusian, Russian and other languages.

3. Placing an order

An enquiry can be submitted through the contact form on the website, by e-mail to docs@pobytw.pl and, once it is launched, also through the order portal. Merely submitting an enquiry or a document does not constitute acceptance of an Order. An Order is accepted once the Office confirms its scope, price, deadline and method of fulfilment.

4. Quotation

Prices published on the website are indicative and given as prices “from”. A binding quote is prepared after receiving a legible document or information sufficient to determine the workload. The price depends in particular on the language pair, the type and volume of the document, and the mode and deadline of fulfilment. The apostille is a separate, additional fee.

5. Payments

The available payment methods and the payment deadline are indicated in the Order confirmation. The Office may make the start of work or the release of the translation conditional on payment of the full price or an agreed advance. The Client will receive an appropriate settlement document in accordance with the applicable regulations.

6. Fulfilment and collection

The turnaround time is agreed individually and runs from the acceptance of the Order and the fulfilment of the agreed conditions, in particular the provision of complete materials and the required payment. The translation may be collected at the office, sent by e-mail, or sent by post or courier — depending on the type of translation and the arrangements with the Client. The cost of shipping may be added to the price of the Order.

7. Liability

A sworn translation is performed by a sworn translator who bears the liability arising from the relevant regulations, in particular the Act on the profession of sworn translator. The Office is liable for the proper performance of the Service on the terms arising from Polish law.

The Client is responsible for the legality, completeness and truthfulness of the materials provided and for holding the right to make them available. The translation reproduces the content of the source document and does not confirm its authenticity or the truthfulness of the information it contains.

8. Complaints

A complaint should be reported as soon as possible after any concerns are discovered, by e-mail to docs@pobytw.pl or in writing to the Office's address, describing the problem and indicating the Order number. The Office will confirm receipt of the complaint and consider it without undue delay, no later than within 14 days. If the complaint is justified, the Office will, as a first step, correct the translation free of charge, insofar as the nature of the matter allows. Consumer rights arising from mandatory provisions of law remain unaffected.

9. Copyright

If the translation constitutes a work within the meaning of copyright law (that is: it has the features of original creative work protected by law — in practice this rarely applies to ordinary official documents), the rules for using it or for transferring the rights are set out in the Order confirmation. Until the full price is paid, the Client may use the translation solely for the purpose of checking it, unless the parties agree otherwise. The Client warrants that providing the source materials does not infringe the rights of third parties.

10. Protection of personal data

Information on the processing of personal data can be found in the Privacy policy.

11. Governing law and courts

These Terms and Orders are governed by Polish law. Disputes are resolved by the competent Polish courts determined in accordance with the applicable regulations. This provision does not limit the consumer's right to use the court with jurisdiction under mandatory provisions of law.

12. Final provisions

The Terms are made available on the website. Changes to the Terms do not affect Orders accepted before the changes take effect, unless required by law or agreed to by the Client. Matters not covered here are governed by the provisions of Polish law.
